Terms of Service

1What Kachkachi is

Kachkachi lets you make wishlists, add gifts from links to any shop, and share a link with friends and family. People you share a link with ("guests") can reserve a gift so nobody buys the same thing twice. Guests don't need an account.

We don't sell the gifts on your lists. When you or a guest follow a link to a shop, the purchase happens on that shop's site, under that shop's terms. We aren't responsible for shops, their products, prices, availability or delivery.

2Your account

• You must be at least 16 years old to create an account. Guests reserving a gift don't need an account.
• Give us accurate information and keep your password secret. You're responsible for activity on your account.
• Your handle and list links (for example kachkachi.com/anna and kachkachi.com/anna/birthday) are public addresses. When you change your handle, your old links redirect to the new one and nobody else can take the old handle while they do. Don't pick ones that impersonate someone else or infringe a trademark. We may reclaim or change a handle or link that breaks these Terms.
• Tell us at support@kachkachi.com if you think someone else has accessed your account.

3Sharing lists and reservations

• Anyone with your list link can view the list. Every account has a profile at kachkachi.com/<handle>. Lists you choose to show there can be found from your profile and by search engines; lists set to "anyone with the link" are not listed.
• A reservation is a courtesy signal between friends, not a purchase or a promise. A guest can cancel a reservation from the device they made it on.
• Owners see that a gift is taken, never by whom. We design the Service to keep it that way, but guests may still choose to tell you themselves.
• Chipping in (Kachkachi Plus) records pledges only. No money moves through Kachkachi; contributors settle up among themselves. We're not a party to those arrangements.

4Acceptable use

Don't use Kachkachi to:

• break any law, or list items that are illegal to sell or give in your country or the guest's country;
• post content that is hateful, harassing, sexually explicit, violent, or that infringes someone else's rights;
• spam people, collect guests' information, or use lists for fundraising, sales or advertising that isn't a genuine personal wishlist;
• scrape, overload, probe or attack the Service, or get around its limits or security;
• impersonate a person or brand, or create accounts in bulk or by automated means.

We may remove content or suspend accounts that break these rules.

5Your content

You own what you add to Kachkachi: list titles, notes, links, your bio and so on. You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy and display that content only as needed to run and improve the Service, including showing it to the people you share it with.

When you add a link, we fetch the page to fill in the title, photo and price. Gift photos are shown from the shop's own servers. You're responsible for making sure you're allowed to share what you add.

6Free and Kachkachi Plus

New Plus members can try Plus free for 14 days, once per account. When a trial ends you go back to Free unless you subscribe. Your lists stay.

We may change features or prices. We'll tell you at least 30 days before a price change affects a subscription you already have. You can cancel before it takes effect.

7Payments, renewal and cancellation

• Web subscriptions are sold by Paddle.com, our reseller and Merchant of Record. Paddle handles payment, invoicing and sales tax, and its Buyer Terms also apply to your purchase.
• Subscriptions are billed in advance and renew automatically each month or year until you cancel.
• You can cancel any time from Plan → Manage billing in your account (/my/plan). You keep Plus until the end of the period you've paid for, then your account moves to Free.
• Purchases made in a mobile app store (if and when offered) are billed by Apple or Google under their terms.

Refunds are covered by our Refund Policy.

8Our rights

The Service, the Kachkachi name, logo and design are owned by DaySync LLC and protected by law. These Terms don't give you any right to use them except to use the Service as intended.

If you send us feedback or ideas, we may use them without any obligation to you.

9Privacy

Our Privacy Policy explains what we collect and why, and our Cookie Policy explains the few cookies we use. Both are part of these Terms.

10Ending your use

You can stop using Kachkachi at any time. To delete your account and its lists, email support@kachkachi.com from your account email. Cancel any paid subscription first so you aren't billed again.

We may suspend or close an account that breaks these Terms, puts others at risk, or has been inactive for a long time. Where reasonable, we'll warn you first. Sections that by their nature should survive (such as ownership, disclaimers and liability limits) survive termination.

11Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

Titles, photos and prices pulled from shop links, and price-drop alerts, are best-effort and may be wrong or out of date. Always check the shop before you buy. We don't guarantee that the Service will be uninterrupted or error-free, or that a reservation will prevent a duplicate gift.

12Limitation of liability

TO THE EXTENT THE LAW ALLOWS, DAYSYNC LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ABOUT THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AND US$50.

Nothing in these Terms limits liability that can't be limited by law, or takes away rights you have as a consumer under the mandatory laws of the country where you live.

13Indemnity

If you use the Service in breach of these Terms or the law, you agree to cover DaySync LLC's reasonable losses and costs arising from claims by others caused by that use, to the extent the law allows.

14Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law rules. Please contact us first; most issues can be solved by email. Any dispute that can't be resolved informally will be heard in the state or federal courts located in Wyoming, unless the mandatory law of your country of residence gives you the right to bring it in your local courts.

15Changes to these Terms

We may update these Terms. If a change is material, we'll let you know by email or in the Service at least 30 days before it takes effect. If you keep using Kachkachi after that, the new Terms apply. If you don't agree, you can close your account.

16General

These Terms (with the Privacy, Cookie and Refund policies) are the whole agreement between you and us about the Service. If part of them is unenforceable, the rest still applies. Not enforcing a right isn't a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a merger, acquisition or sale of assets. We're not liable for delays caused by events beyond our reasonable control.
